Roomsy Terms of Service

These terms explain eligibility, acceptable use, ads, limits, dispute handling, and other rules for using Roomsy.

1. Acceptance of Terms

By downloading, installing, or using Roomsy you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App. These Terms constitute a legally binding agreement between you and Nikolas Ayala ("Developer").

2. Eligibility & Age Verification

You must be at least 18 years old to create an account or use Roomsy. By registering, you represent and warrant that you meet this age requirement. The App is intended for users located in the United States.

Roomsy is distributed through the Apple App Store (rated 18+) and Google Play. We use Google's Play Age Signals API and Apple's Declared Age Range API, where available through platform services, to support age assurance and ineligible-age access prevention. Both platforms independently enforce age-based access controls at the platform level. Users identified as ineligible based on platform age signals (Play Age Signals API or Apple's Declared Age Range API) won't be able to access the App.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information at registration and to keep it up to date. You may not create more than one account or create an account on behalf of someone else.

4. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable law.
  • Post, communicate, or engage in discriminatory content or conduct based on any protected characteristic under applicable law, including applicable fair housing and civil rights laws.
  • Post content that is abusive, harassing, hateful, obscene, or fraudulent.
  • Create false or misleading housing listings, misrepresent authority to lease or occupy a property, or use the App for rental or roommate scams.
  • Impersonate any person or misrepresent your identity or intentions.
  • Attempt to gain unauthorized access to other users' accounts or data.
  • Use the App for commercial solicitation, spam, or scams.
  • Reverse engineer, decompile, or otherwise attempt to extract the source code of the App.
  • Use automated tools (bots, scrapers, etc.) to interact with the App.

Users are solely responsible for complying with all applicable housing, anti-discrimination, landlord-tenant, and related laws. Violation of these rules may result in immediate account termination.

5. Advertisements

Roomsy is free to use and is supported by advertisements served by Google AdMob. By using the App you consent to the display of ads, which may include:

  • Banner ads displayed throughout the App.
  • Interstitial ads shown periodically during use (approximately every 10 swipes).
  • Rewarded ads you may voluntarily watch in exchange for 5 bonus swipes when your daily swipe limit is reached.

We do not control the content of third-party advertisements. You can opt out of personalized ads through your device settings.

6. Usage Limits

To maintain a fair experience for all users, the following limits apply:

  • Daily swipes: You may swipe up to 30 profiles per day. The limit resets every 24 hours. You may watch a rewarded ad to receive 5 additional swipes when your daily limit is reached.
  • Daily messages: You may send up to 10 messages per day per conversation. This limit resets every 24 hours.

These limits are enforced server-side and cannot be bypassed by clearing app data, reinstalling, or creating additional accounts.

7. User Content

You retain ownership of any photos or text you submit to the App. By submitting content you grant the Developer a limited, non-exclusive license to store and display that content solely for the purpose of operating the App. You represent that you have the right to share any content you upload and that it does not infringe any third party's rights.

8. Account Termination

The Developer reserves the right to suspend or permanently terminate any account, at our sole discretion, for violation of these Terms, abusive behavior, fraudulent activity, or any other reason we deem appropriate. You may delete your account at any time from within the App.

9. Disclaimers

Roomsy is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the App will be uninterrupted, error-free, or that any roommate match will be suitable. We are not responsible for the conduct, online or offline, of any user of the App. You use the App and meet other users at your own risk.

Platform Role Only: Roomsy is a technology platform that facilitates introductions and matching. Roomsy is not a landlord, property manager, broker, real estate agent, legal advisor, or financial advisor.

No Legal Advice: Roomsy does not provide legal advice regarding residency requirements, tenant rights, leasing laws, or any housing-related legal matters. Users should consult with appropriate legal professionals regarding lease agreements, tenant law, and rental disputes.

No Background Checks or Identity Verification: Roomsy does not conduct background checks, credit checks, or independently verify the identity, age, or accuracy of information provided by users. Users should independently verify information about other users and exercise caution before meeting or entering into agreements with other users.

Profile Authenticity: We do not verify the authenticity of profile photos, written content, or personal information provided by users. Profiles may contain inaccurate, outdated, or misleading information.

Offline and In-Person Responsibility: Roomsy is not responsible for any interactions, decisions, actions, agreements, disputes, conflicts, payments, property access arrangements, or incidents that occur between users offline, in person, or outside the App. This includes but is not limited to disputes over rental agreements, lease terms, financial arrangements, security deposits, housing conditions, and personal conflicts.

Rental and Financial Matters: Roomsy is not responsible for rental agreements, lease disputes, financial arrangements, housing-related disputes, or conflicts between users regarding housing matters. Any agreements between users regarding housing are solely between those users and are independent of Roomsy.

Age Verification Limitations: While we use platform age signals provided by the Apple App Store and Google Play to support age assurance and enforce minimum age requirements, we do not independently verify user age. We cannot guarantee accurate age verification, and users may misrepresent their age.

10. Indemnification

You agree to defend, indemnify, and hold harmless Nikolas Ayala, Roomsy, and their affiliates, officers, agents, and service providers from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees and costs) arising out of or related to: (a) your access to or use of the App; (b) your content, profile information, listings, messages, or interactions with other users; (c) your violation of these Terms or applicable law; (d) your infringement or misappropriation of any third-party rights, including intellectual property, privacy, publicity, housing, or anti-discrimination rights; or (e) any dispute, agreement, or transaction between you and another user.

We reserve the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense of such claims. You may not settle any matter that imposes liability or obligations on us without our prior written consent.

11. Limitation of Liability

To the fullest extent permitted by applicable law, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, including but not limited to damages for lost profits, lost data, personal injury, or property damage. Our total liability to you for any claim shall not exceed the total amount you paid us in the three months preceding the claim.

12. Fair Housing and Non-Discrimination

Roomsy is committed to fair housing compliance. Users may not post, request, or communicate any listing terms, roommate preferences, or other statements that discriminate against any person based on protected characteristics under applicable law.

Under the U.S. Fair Housing Act (FHA), protected classes include: race, color, religion, sex (including sexual orientation and gender identity), disability, familial status, and national origin. Additional state and local laws may protect other characteristics, and users must comply with all applicable laws.

Discriminatory listings, profile content, messages, or preferences are strictly prohibited. If notified through user reports, prohibited content may be removed without notice, and accounts may be suspended or terminated.

13. User Responsibility for Listing Compliance

If you post a housing listing or housing-related preference, you are solely responsible for ensuring that your content and conduct comply with all fair housing, civil rights, landlord-tenant, and anti-discrimination laws. Roomsy is a platform provider and does not provide legal advice on listing legality or compliance obligations.

14. Moderation and Enforcement

Roomsy primarily enforces fair housing and anti-discrimination rules through user reports and manual review. If content or conduct is reported, we may investigate, remove violating content, restrict account features, suspend, or terminate accounts.

15. Arbitration and Class Action Waiver

Agreement to Arbitrate: By using Roomsy, you agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the App (collectively, "Disputes") will be resolved exclusively through binding individual arbitration, except as expressly provided below. This includes, but is not limited to, claims related to your use of the App, interactions with other users, content you submit or view, and alleged violations of law.

Arbitration Procedure: Arbitration will be administered by the American Arbitration Association (AAA) in accordance with its applicable consumer arbitration rules. The arbitration will be conducted by a single neutral arbitrator. Proceedings may be conducted remotely (such as by phone or video) where appropriate. The arbitrator will have authority to award any relief available under applicable law.

No Jury Trial: YOU AND ROOMSY WAIVE ANY RIGHT TO A JURY TRIAL OR TO HAVE A DISPUTE HEARD IN COURT, except for matters that may be brought in small claims court as described below.

Class Action Waiver: YOU AND ROOMSY AGREE THAT ALL DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY. To the fullest extent permitted by law, you may not bring a claim as a plaintiff or class member in any class, collective, or representative action, and you may not combine or consolidate your claim with those of other users. The arbitrator may not preside over any form of class or representative proceeding.

Small Claims Exception: Either you or Roomsy may bring an individual claim in small claims court in New Jersey (or your state of residence, if applicable), provided the claim qualifies and remains on an individual (non-class) basis.

Opt-Out Right: You may opt out of this arbitration agreement by sending written notice to reportstonick@gmail.com within 30 days of first accepting these Terms. Your notice must include your full name, the email associated with your account, and a clear statement that you wish to opt out of arbitration. If you opt out, disputes will be resolved in accordance with the Governing Law section of these Terms. If we materially modify these Terms in a way that affects the arbitration agreement, you will have a new 30-day opt-out period starting from the effective date of the modification.

Severability: If any portion of this arbitration agreement or class action waiver is found to be unenforceable, the remaining portions will remain in full force and effect, except that if the class action waiver is found unenforceable, then this entire arbitration section shall be null and void.

Governing Law: These Terms are governed by the laws of the State of New Jersey, without regard to its conflict of law principles.

16. California Residents (CCPA)

We do not sell personal information. We may share certain identifiers with advertising partners, such as Google AdMob, for targeted advertising, as those terms are defined under applicable law. You may opt out of this sharing at any time by navigating to the FAQ section in settings.

17. Privacy Choices and Ad Preferences

If you use the App on a device where AdMob state privacy messaging or GDPR consent is applicable, we will present an in-app privacy choices prompt before serving ads. This prompt asks whether you consent to the collection and use of your advertising identifier and related device signals by Google AdMob for the purpose of serving you personalized advertisements. If you decline, ads may still be shown but will not be personalized based on your interests or activity.

You can review or change your ad privacy choices at any time through the FAQ screen in the App. Changes take effect for future ad requests.

18. DMCA Copyright Policy

If you believe content in Roomsy infringes your copyright, you must complete both steps below.

Step 1 (Mandatory In-App Action): You must block and report the user who presents the copyrighted content in the Roomsy app before, or at the time, you submit your DMCA notice. This is required so we can identify the exact account and process your request accurately. Screenshots alone are not sufficient because multiple users may share similar profile names and information.

Step 2 (DMCA Notice by Email): After completing the in-app report, send a DMCA notice to our designated copyright agent:

Your DMCA notice should include your full name and contact information, identification of the copyrighted work, identification of the allegedly infringing content with enough detail for us to locate it, a statement confirming you already blocked and reported the user in-app, a good-faith statement, a statement under penalty of perjury that the notice is accurate and you are authorized to act, and your physical or electronic signature.

Upon receipt of a valid DMCA notice and confirmation of an in-app report, we may remove or disable access to the allegedly infringing content and may notify the user who posted it.

Counter-Notice: If you believe your content was removed by mistake or misidentification, you may submit a counter-notice to reportstonick@gmail.com with subject line DMCA Counter-Notice. Your counter-notice should include your name and contact information, identification of removed content and its prior location, a statement under penalty of perjury that removal was a mistake or misidentification, a consent-to-jurisdiction statement for the appropriate U.S. federal court, and your physical or electronic signature.

Repeat Infringer Policy: Roomsy may suspend or terminate accounts of repeat infringers in appropriate circumstances.

19. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Roomsy regarding your use of the App and supersede any prior agreements or understandings, whether written or oral.

20. Changes to These Terms

We may modify these Terms at any time. When we do, we will update the effective date at the top of this section. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
